What is Mediation

 

 

“We can take the  work out of setting up your case for mediation or arbitration.”

  Typically, all parties have already agreed to mediation  or arbitration and we are contacted to help select a mediator and find a date, time and location that works for everyone.  We can help with the discussion of fee division if necessary.

In many cases the parties agree to split the mediation costs, although it is not uncommon for one party to pay the entire cost - sometimes fees are paid as part of a final agreement.

   

   Sometimes one side of a dispute contacts USA&M and asks us to propose mediation to the other parties.  If the other side is not totally for mediation or arbitration, it helps for us to be the ones to initially discuss it with them because we feel that as an impartial organization we have a greater chance of gaining their participation.  We do not charge any fee if a necessary party declines to participate and no Notice of Mediation has been sent out.

 

  

What is mediation?

   Mediation is simple and straightforward. At a session, all sides of a dispute sit down with an impartial person (mediator) to attempt to reach a mutually acceptable settlement.  There are no formal court procedures or rules of evidence.  The mediator has no authority to render a decision or force parties to accept a settlement.

   Mediation is useful for all kinds of disputes.  It makes no difference whether liability is admitted or hotly contested, whether the case is in litigation or not yet filed, or whether the case involves a few thousand dollars or millions.

 

   With mediation you can settle disputes now, save money, maintain control, improve everyone's understanding, informally explore settlement options, organize multiple party negotiations and preserve continuing relationships.
