VII. Miscellaneous
Rule 46. Representation
All parties shall be represented by counsel.
Rule 47. Time Computation
The computation of time will not include the day that notice from USA&M of Oregon is sent. Saturday, Sunday, and legal holidays are included in the computation, unless it is the last day of the period.
The term “legal holiday” is defined in ORS 187.010 and 187.020.
Rule 48. Waiver of rules or applicable laws
Any party, who proceeds with the arbitration after knowledge that any provision or requirement of these rules or any applicable laws has not been complied with, and who fails to state objection in writing, shall be deemed to have waived the right to object.
Rule 49. Exclusion from Liability
Arbitrators and arbitration administrators are entitled to a qualified good faith immunity from suit.
Rule 50. Confidentiality
The parties, the arbitration administrator, and the arbitrator will maintain the confidential nature of the arbitration proceeding and the award, including the hearing and the written explanation of the award, except as necessary in connection with a judicial challenge to or enforcement of an award or unless otherwise required by law.
Rule 51. Amendment of Rules and Fees
USA&M of Oregon may amend these rules and their fee schedule without notice. These rules and schedules, and any amendments, shall apply in the form existing at the time the demand for arbitration is initiated.
Rule 52. Conflict with Law
If any of these rules is discovered to be in conflict with a mandatory provision of applicable law, the provision of law will govern, and no other rules will be affected.
Rule 53. Right of Refusal
USA&M of Oregon reserves the right to refuse to administer any case and shall not be required to disclose the reasons for any such refusal.
Rule 54. Matters not Addressed & Authority of the Arbitration Administrator
The arbitration administrator, in his or her sole discretion, to fit the circumstances of a particular case may alter any of the above procedures. Any matter not specifically addressed by these rules, or any conflict or ambiguity of these rules, will be decided by the arbitration administrator, in his or her sole discretion. The arbitration administrator, in his or her sole discretion, has authority to prepare forms, resolve procedural disputes, impose time limits on the parties, and otherwise require a party to take action or refrain from taking action.
