Contract Clauses

"In the event a dispute shall arise between the parties to this ______(contract, lease, etc.), it is hereby agreed that the dispute shall be referred to USA&M OF OREGON. INC., for arbitration in accordance with its Rules of Arbitration and with ORS 36.600 et. seq.  The arbitrator's decision shall be final and binding and judgment may be entered thereon.

 

In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award or fails to comply with the arbitrator's award, the other party is entitled to costs of suit including a reasonable attorney's fee for having to compel arbitration or defend or enforce the award.

 

This arbitration agreement substantially affects your legal rights.  By agreeing to arbitrate, parties give up their legal right to bring a court action and have a jury trial.  Contact an attorney if you have any questions concerning the use of this arbitration clause."

Arbitration Clause: a business contract, or other written contract may contain an "arbitration clause." By using such a clause, the parties to the contract agree beforehand to arbitrate any future disputes.  As with any contract clause, all parties must agree to it and the following arbitration clause does not have to be used "as is" in order to use our services.

"In the event a dispute shall arise between the parties, the parties agree to participate in ____ hours (4 or 6 hours is recommended) of mediation in accordance with the Mediation Procedures of USA&M of OREGON, INC. the parties agree to equally split the costs of such mediation."

Mediation Clause: The parties may wish to agree to mediate by using the following clause:

"In the event a dispute shall arise between the parties, the parties agree to participate in ____ hours (4 or 6 hours is recommended) of mediation in accordance with the Mediation Procedures of USA&M of OREGON, INC. the parties agree to equally split the costs of such mediation."

 

If mediation is unsuccessful, the parties agree to submit their dispute to arbitration under ORS 36.600 et. seq. and the Arbitration Procedures of USA&M OF OREGON, INC.   The arbitrator's decision shall be final and binding and judgment may be entered thereon.
